Terms of Service

These Terms of Service govern your use of Build Elite, which is operated by Handsome Bear Construction Inc., a California corporation.

Welcome to Build Elite and its Industry Hub (collectively, the "Platform").

By accessing or using the Platform, you agree to these Terms of Service.

1. Acceptance of Terms

These Terms of Service govern your access to and use of the Platform.

If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Platform.

You represent that the information you provide is accurate and that you have authority to enter into these Terms.

3. Account Registration

When registering an account, you agree to:

  • Provide truthful basic information
  • Keep your credentials secure
  • Not impersonate another person or entity
  • Not misuse or abuse the Platform

We may restrict, suspend, or delete accounts that violate these Terms.

4. Platform Role

Build Elite and its Industry Hub are industry information and connection platforms.

The Platform provides:

  • Industry user profiles and discovery
  • Industry cooperation features
  • Recruiting information
  • Work opportunities
  • Chat and industry communication tools

The Platform is not:

  • An employer
  • A staffing agency
  • A labor contractor
  • An employment agency

The Platform is not responsible for cooperation, employment, payment, or project outcomes between users.

5. User Responsibilities

Users are solely responsible for:

  • Employment relationships
  • Wage payment
  • Taxes
  • Work authorization and qualifications
  • Jobsite safety
  • OSHA compliance
  • Insurance
  • Contracts
  • Licenses
  • Project risk

The Platform does not provide legal, tax, or employment guarantees.

6. Contractor and Provider Information

Users who publish contractor, provider, architect, handyman, supplier, worker, or related profile information are responsible for the accuracy and legality of that information.

The Platform does not independently verify every statement made by users unless expressly stated in a product feature.

7. Project and Cooperation Requests

The Platform provides information and connection services only.

The Platform does not guarantee:

  • The truthfulness of opportunities
  • Project results
  • Payment performance
  • Wages
  • Successful cooperation
  • User conduct

Users must evaluate cooperation and project risk on their own.

8. Payments and Transactions

Unless expressly stated in a specific Platform feature, Build Elite does not process payments between users for construction, repair, design, labor, or cooperation services.

Any payment terms are solely between the users involved.

9. Prohibited Conduct

User content and conduct must not include:

  • Illegal content or activity
  • Fraud or misrepresentation
  • Harassment or abuse
  • Discrimination
  • Dangerous or unsafe instructions

We may remove violating content and restrict accounts.

10. Platform Rights

We may:

  • Modify Platform features
  • Remove content
  • Restrict accounts
  • Suspend service
  • Adjust membership or visibility rules

Where reasonable, we may do so without advance notice.

11. Intellectual Property

The Platform, its branding, software, and related materials are owned by Build Elite or its licensors and are protected by applicable intellectual-property laws.

You may not copy, modify, reverse engineer, or exploit Platform materials except as permitted by law or with our written consent.

You retain ownership of content you submit, but grant the Platform a limited license to host, display, and process that content as needed to operate the service.

12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

We do not guarantee:

  • Uninterrupted service
  • Accuracy of all information
  • Safety of user conduct
  • Project success
  • Financial results

You use the Platform at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law:

Build Elite is not liable for:

  • Project losses
  • Lost income
  • Wage disputes
  • Contract disputes
  • Jobsite accidents
  • Personal injury
  • Indirect or consequential damages

14. Indemnification

You agree to defend, indemnify, and hold harmless Build Elite from claims, losses, and expenses arising out of your use of the Platform, your content, your cooperation with other users, or your violation of these Terms or applicable law, to the extent permitted by law.

15. Third-Party Conduct

The Platform is not responsible for the conduct of other users, including:

  • Contractors
  • Handymen
  • Skilled workers
  • Architects
  • Consultants
  • Clients

Users must evaluate cooperation risk independently.

16. Termination

We may terminate or suspend accounts for reasons including:

  • False information
  • Fraud
  • Platform abuse
  • Illegal activity
  • Security risk

17. Governing Law

These Terms are governed by the laws of the United States and the state in which the user primarily accesses the Platform, without regard to conflict-of-law rules, except where mandatory consumer protections apply.

18. Changes to Terms

We may modify these Terms at any time.

The Effective Date and Last Updated date at the top of this page will reflect material revisions.

Continued use after changes means you accept the revised Terms.

19. SMS Terms

By providing a mobile phone number and requesting a verification code or enabling SMS notifications, the user consents to receive transactional text messages from Build Elite. Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of purchasing any goods or services. Reply STOP to opt out and HELP for assistance.
